"The Company", "Ourselves", "We" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same. If you don't accept our Terms & Conditions, please do not use our Site.

Please read these Terms & Conditions carefully before you use our Site as this is a legally binding agreement and contains important information on your legal rights and obligations.

Accessing and using our Site

You are only permitted to register on our Site and use the Services if you are resident in the UK and at least 18 years old. By using the Site, you confirm that you are a resident in the UK and at least 18 years old. Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services and/or your access to the Site without prior notice. From time to time, we may restrict access to some parts of our Site or our entire Site. We will not be liable if for any reason our Site or any of the Servicers are unavailable at any time or for any period.

Registering on the Site

Before you are able to use the Services, you need to complete the registration process. As part of the registration process we may ask you to provide some basic personal information and a specific confirmation that you agree to the Terms & Conditions and the terms of the Privacy Policy. The Privacy Policy explains how we use any personal information you provide to us.

When you register you must provide your real name (not a pseudonym) and you must provide us with genuine valid contact details.

We have the right to disable any user account or password, whether chosen by you or allocated by us and/or restrict your access to the Site, at any time, if in our opinion you, or someone using your user account or password, has failed to comply with any of the provisions of these Terms &Conditions. We are under no obligation to reactivate your account once it has been disabled. If your account or access to the Site is terminated (whether by you or by us) these Terms & Conditions will remain in effect. Where a registration is made by two or more persons, any obligations of a person in, under or arising from these Terms and Conditions is undertaken by and binding upon such two or more persons jointly and severally. You are responsible for making all arrangements necessary for you to have access to our Site. You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these Terms & Conditions, and that they comply with them. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details within the Site. We reserve the right to terminate any account for the Site where that account has been inactive for a period in excess of three months, at which point we will have the right to delete all information relating to that account (although we are not required to do so).Where you are applying for a loan, your application may be subject to further conditions, terms and rules of the Third Party Company (the "Lender") who will offer the loan. The Lender may refuse your application at its sole discretion.

Your responsibility to provide accurate information

Where we request information from you on the Site or otherwise, you must ensure that this information is accurate, complete and not misleading. We will rely on this information and so we reserve the right to terminate your registration and/or your access to this Site if we believe that the information you provide to us is inaccurate, untrue or misleading. In addition, if the information you provide to us is inaccurate, untrue or misleading you are likely to be in breach of any agreement you have entered into with a lender. Furthermore, misleading information may also result in the instigation of criminal procedures against the Client. You take full responsibility for any loss or damage incurred through the provision of misleading or incorrect information to us by you. Our Services

Heartpaydays is a free credit broker not a direct lender and therefore, we will not provide finance directly to you. Our service is such that upon completion of your application form, we will introduce you to lenders of finance providers who may be able to assist with your application for finance. By submitting an application you will be giving your consent for us to match your application with one of the Lenders or Providers on Our panel. It is important to understand that We will only forward your application to a Lender or Finance Provider that has looked at Your application and accepted it as one they believe there is a good chance they can provide a loan or relevant services to You. For doing this we shall receive the commission through an intermediary.

Checks and references

We do not at any time carry out any credit checks on our Clients. However, Lenders may use external credit reference agencies and credit scoring services to ascertain your eligibility for a loan or finance product. Whether you are eligible for a loan or finance product is at the Lender's sole discretion. In accordance with the terms of our Privacy Policy, we may pass your personal information to prospective Lenders to enable them to consider/decide whether to make a loan to you. This may involve credit and identity checking, and may involve third parties as appropriate.

Trademarks and copyright

All copyright, trademarks, database rights and all other intellectual property rights in our Site and its content (including without limitation the pages screens, information and material) included in our Site and all software and source codes connected with the Site is owned by or licensed to us unless otherwise noted. You are granted a limited licence to access and use the Site and our content in the Site for your personal use as envisaged by these Terms & Conditions, provided that you keep all copyright and other proprietary notices intact. Our content of the Site may not be copied, distributed, modified, adapted, translated, reproduced in whole or in part without our prior written permission, except that you may print off a copy, and may download extracts, of any page(s) from our Site for your personal reference and you may draw the attention of others to material posted on our Site. Indemnity

You agree to indemnify us and keep us indemnified from and against all costs, claims, expenses (including reasonable legal and professional fees and expenses), losses, damages and other liabilities suffered or incurred by us and arising out of or in connection with your use of the Site, or any breach of these Terms & Conditions by you, or the infringement by you, or any other user of your registration account for the Site, of any intellectual property or other right of any person or entity except to the extent that any such costs, expenses, losses, damages or other liabilities were caused or contributed to by any negligence or breach of these Terms & Conditions by us.

Waiver

No delay or failure by us to insist upon or enforce performance of any provision of the Terms & Conditions or to exercise any right under the Terms & Conditions will be deemed to be a waiver or in any way prejudice our rights under these Terms & Conditions.

Severance

If any provision in these Terms & Conditions is declared void or unenforceable by any court or other body of competent jurisdiction, or is otherwise rendered so by any applicable law, such provision shall to the extent of such invalidity or unenforceability be deemed severable and all other provisions of these Terms & Conditions not affected by such invalidity or unenforceability shall remain in full force and effect.

Jurisdiction and applicable law

These Terms & Conditions and all claims arising out of or in connection with these Terms & Conditions, the Services, this Site and the use of it are governed by the laws of England and Wales. The English and Welsh courts shall have exclusive jurisdiction over any disputes (including non-contractual disputes or claims) under these Terms & Conditions or connected to or arising out of use of the Site and/or the Services. If you use information or Services provided on this Site from outside the UK, you are responsible for ensuring your use conforms to local laws as well as the laws of England and Wales although we retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country.
